Wrongful Death Lawsuit Filed in Disney Monorail Pilot’s Death Dismissed

Two years ago, on July 5 2009, Walt Disney World monorail pilot Austin Wuennenberg was killed when two monorails crashed at the Transportation and Ticket Center. According to official documents from the National Transportation Safety Board, the other pilot stated he never saw Wuennenberg as he backed up the train he was piloting.

However, earlier last year Wuennenberg’s mother filed suit against Walt Disney World Parks and Resort, claiming that her son’s supervisor had left his post, thereby creating a “dangerous situation.” Now, though, the lawsuit has been dismissed. Lawyers for both parties have reported the lawsuit as settled, but decline to state further details.

While the Occupational Safety and Health Administration (OSHA) fined Disney $44,000 for the crash, the NTSB investigation remains open and ongoing.
